      Raisons de la décision d"adjudication: selon le rapport d"évaluation, l"offre du soumissionnaire Elkuch Eisenring AG, Jonschwil, convainc pour une bonne évaluation de tous les critères d"attribution.

      Indication des voies de recours: conformément à l"art. 30 LMP, la présente publication peut être attaquée, dans un délai de 20 jours à compter de sa notification, auprès du Tribunal administratif fédéral, case postale, 9023 Saint-Gall. Le mémoire de recours, à présenter en 2 exemplaires, indiquera les conclusions, motifs et moyens de preuve et portera la signature de la partie recourante ou de son mandataire; y seront jointes une copie de la présente publication et les pièces invoquées comme moyens de preuve, lorsqu"elles sont disponibles.

      1. État des lieux: pas prévu.

      2. L"offre sera adjugée à condition que le projet soit prêt pour une acquisition publique et que les crédits nécessaires soient à disposition.

      3. L"élaboration des offres ne donne droit à aucun remboursement. La documentation relative à l"offre ne sera pas rendue.

      4. L"ouverture des offres n"est pas publique.

      6. En vertu de l"article 13, paragraphe 1, lettre h, OMP et de l"article XV, lettre D, GPA (Governement Procurement Agreement) l"adjudicateur se réserve le droit d"attribuer, par entente directe, le marché de nouvelles adjudications du même type, fondé sur la présente adjudication de base.

      7. Le contrat d"entreprise sera stipulé et signé au Tessin. Par conséquent, il sera assujetti à l"impôt de timbre selon la Loi cantonale sur l"impôt de timbre et les spectacles cinématographiques (uniquement pour les marchés de construction).

      8. L"adjudicateur se réserve le droit de reporter les dates indiquées (en particulier pour l"adjudication et le début des travaux). Dans un tel cas, le soumissionnaire n"a pas droit à indemnisation.

      9. La publication sur le SIMAP fait foi. En cas de doutes ou de contradictions, le texte de publication en langue italienne fait foi.

      10. La langue utilisée pour le projet est l"italienne. Le soumissionnaire doit garantir la communication (écrite et orale) dans cette langue.
